Ihr Instagram Bild/Video hat unsere Aufmerksamkeit erweckt und wir würden es gerne mit unserer Community teilen. Die Deichmann SE, Deichmannweg 9, 45359 Essen, Deutschland, möchten Ihr Instagram Bild oder Video („Content“) auf den von uns genutzten Social Media Kanälen, Webseiten, Newslettern, Material in unseren Geschäften oder zu anderer Kundenkommunikation verwenden.

Wenn Sie auf den Kommentar unseres Instagram Kontos mit #yesdeichmann antworten, oder ein Bild über die Hochladefunktion auf unserer Webseite hochladen, bestätigen und bevollmächtigen Sie uns zu dem Folgenden:

1. Sie sind mindestens 18 Jahre alt. Deichmann behält sich das Recht vor, Sie dazu aufzufordern Ihre Identität durch Vorlage eines gültigen Personalausweises zu bestätigen.

2. Ihr Content steht in Verbindung zum Produktportfolio von Deichmann. Der Inhalt verletzt nicht die Rechte Dritter und ist nicht gesetzeswidrig, insbesondere nicht diskriminierend und diffamierend. Der Inhalt enthält keine vertraulichen Informationen und bezieht sich nicht auf religiöse, politische oder philosophische Ansichten.

3. Sie reichen keinen Content ein, der hasserfüllt, bedrohlich, rassistisch oder pornografisch ist. Ihr Content steht nicht im Zusammenhang mit Alkohol, Drogen, Tabak oder Medikamenten. Er ermutigt nicht zu kriminellem Verhalten, enthält keine Nacktheit, Gewalt und ist auch sonst nicht beleidigend, unanständig oder obszön.

4. Sie gewähren Deichmann eine nicht-exklusive, unentgeltliche, weltweit gültige Lizenz, Ihren Content für PR und Werbezwecke von Deichmann zu nutzen. Dies beinhaltet digitale und analoge Kanäle, wie unsere Webseite, Newsletter, Social Media Kanäle oder Material in unseren Geschäften. Die Deichmann gewährte Lizenz ist grundsätzlich unbefristet, Sie können diese jedoch jederzeit mit Wirkung für die Zukunft widerrufen. Wenn Sie nicht mehr möchten, dass wir Ihren Content nutzen, schicken Sie uns einfach eine Nachricht an privacy-DSD@deichmann.com.

5. Sie versichern und garantieren uns, dass Sie alle Rechte halten, die notwendig sind, um die Rechteübertragung gemäß Ziffer 4 zu ermöglichen (einschließlich der Rechte zu geistigem Eigentum in Ihrem Content und die Erlaubnis aller Personen, die in Ihrem Content erscheinen). Sie bestätigen, dass Sie keine Verpflichtungen eingehen oder eingegangen sind, die Sie daran hindern oder darin einschränken könnten, uns diese Rechte zu übertragen.

6. Sie verstehen, dass wir Ihren Content verwenden dürfen, jedoch dazu nicht verpflichtet sind. Sie verstehen, dass wir Ihren Content – unter Beachtung Ihrer Urheberpersönlichkeitsrechte – nutzen, bearbeiten, verändern, oder mit anderem Content kombinieren dürfen. Sie akzeptieren, dass wir bei Ihnen keine Genehmigungen für unsere Nutzung Ihres Contents nach den hiernach vereinbarten Bedingungen einholen müssen.

7. Sie akzeptieren, dass die Benutzung Ihres Contents durch uns kostenfrei ist.   Sie entbinden uns von allen Ansprüchen, Schäden, Verbindlichkeiten, Kosten und Aufwendungen, die sich aus einer Verletzung möglicher Rechte Dritter für unsere Nutzung Ihres Contents ergeben und entschädigen uns für jegliche Kosten, die sich daraus ergeben können.

8. Sie verstehen, dass wir für folgende im Zusammenhang mit der Nutzung Ihres Contents entstehenden Sachverhalte, nicht haften können:

- Eine Verringerung des Wertes des Contents
- Verlust von geschäftlichen Möglichkeiten, Firmenwert oder Reputation
- Verlust von Gewinnen, Verkäufen, Geschäften, Einnahmen oder erwarteten Einsparungen
- Folgen von Betriebsunterbrechungen
- Jegliche direkte oder Folgeschäden

9. Diese Teilnahmebedingungen unterliegen dem Recht der Bundesrepublik Deutschland. Wenn Sie Ihren Content einreichen und zum Zeitpunkt der Zustimmung zu diesen Teilnahmebedingungen ihren gewöhnlichen Aufenthaltsort außerhalb Deutschlands haben, bleiben die einschlägigen, zwingenden gesetzlichen Vorschriften des Landes Ihres gewöhnlichen Aufenthaltsortes unberührt.

10. Deichmann ist berechtigt, jederzeit und ohne Erklärungen oder Vorankündigungen Fotos abzulehnen, Material zu löschen, den Nutzer von der Teilnahme auszuschließen, wenn Inhalte gegen diese Teilnahmebedingungen verstoßen. Deichmann ist ferner berechtigt, das Angebot jederzeit einzustellen. Schadensersatzansprüche sind ausgeschlossen.

Wenn Sie Ihre Meinung bezüglich unserer Nutzung Ihres Contents ändern oder wenn Sie ein Marken- / Urheberrechtsinhaber sind und glauben, dass der Content eines Nutzers gegen diese Rechte verstößt, kontaktieren Sie uns bitte unter privacy-DSD@deichmann.com. Bitte geben Sie uns genügend Informationen, damit wir den betreffenden Content und ggf. den Eigentümer des Contents identifizieren können.

Bitte beachten Sie, dass ein Löschen Ihres Contents auf Ihrem Instagram Account nicht dazu führt, dass dieser Content in den unter Ziffer 4 genannten Kanälen gelöscht wird. Bitte schreiben Sie uns eine Nachricht an privacy-DSD@deichmann.com, wenn wir Ihren Content löschen sollen.

Bitte beachten Sie, dass wir keine Kontrolle über die Nutzung Ihres Contents durch Dritte auf Webseiten haben, die wir nicht kontrollieren. Wenn Sie das Entfernen von Ihrem Content auf Webseiten Dritter verlangen möchten, sollten Sie diese Seiten direkt kontaktieren.

Your Instagram image/video has caught our attention and we would like to share it with our community. The Deichmann SE, Deichmannweg 9, 45359 Essen, Germany, would like to use your Instagram image or video ("Content") on the social media channels, websites, newsletters, material in our stores or for other customer communications we use.

If you reply to the comment of our Instagram account with #yesdeichmann, or upload an image via the upload feature on our website, you acknowledge and authorize us to do the following:

1. You are at least 18 years old. Deichmann reserves the right to ask you to confirm your identity by presenting a valid identity card.

2. Your content is related to Deichmann's product portfolio. The content does not infringe the rights of third parties and is not illegal, in particular non-discriminatory and defamatory. The content does not contain confidential information and does not refer to religious, political or philosophical views.

3. Do not submit content that is hateful, threatening, racist or pornographic. Your content is not related to alcohol, drugs, tobacco or medication. It does not encourage criminal behavior, contains no nudity, violence, or is otherwise offensive, indecent, or obscene.

4. You grant Deichmann a non-exclusive, royalty-free, worldwide license to use your content for Deichmann's PR and advertising purposes. This includes digital and analogue channels such as our website, newsletters, social media channels or material in our stores. The license granted to Deichmann is unlimited in principle, but you can revoke it at any time with effect for the future. If you no longer wish us to use your content, simply send us a message at privacy-DSD@deichmann.com.

5. You guarantee us that you own all rights necessary to permit the assignment of rights under paragraph 4 (including intellectual property rights in your Content and the permission of all people appearing in your Content). You acknowledge that you do not enter into or have entered into any obligations that may prevent or restrict you from assigning such rights to us.

6. You understand that we may use your Content, but are not obligated to do so. You understand that we may use, edit, modify, or combine your Content with other Content, subject to your privacy and copyrights. You agree that we do not need to obtain any permission from you to use your Content under the terms and conditions set forth herein.

7. You agree that we may use your Content free of charge. You indemnify us against all claims, damages, liabilities, costs and expenses arising out of any infringement of any third party rights in our use of your Content and hold us harmless from any costs that may arise therefrom.

8. You understand that we shall not be liable for any of the liability arising out of or in connection with the use of your Content:

- A reduction in the value of the Content
- Loss of business opportunity, goodwill or reputation
- Loss of profits, sales, business, revenue or expected savings
- Consequences of business interruptions
- Any direct or consequential damages

9. These conditions of participation are subject to the law of the Federal Republic of Germany. If you submit your content and have your usual place of residence outside Germany at the time of agreeing to these Terms of Participation, the relevant mandatory legal provisions of the country of your usual place of residence shall remain unaffected.

10. Deichmann is entitled to refuse photos, delete material or exclude the user from participation at any time and without explanations or prior notice if content violates these conditions of participation. Deichmann is also entitled to discontinue the offer at any time. Claims for damages are excluded.

If you change your mind about our use of your content or if you are a trademark/copyright holder and believe that a user's content violates these rights, please contact us at privacy-DSD@deichmann.com. Please provide us with sufficient information to enable us to identify the content in question and, if applicable, the owner of the content.

Please note that deleting your content from your Instagram account will not cause this content to be deleted from the channels listed in section 4. Please send us a message to privacy-DSD@deichmann.com if you want us to delete your content.
Please note that we have no control over the use of your content by third parties on websites that we do not control. If you wish to request that your content be removed from third party websites, you should contact those sites directly.
